Railway Leave Rules: Eligibility and Conditions of Commuted Leaves for Railway Employees.

In the Indian Railways, leave rules are designed to provide employees with necessary time off for various personal and health needs. One of the critical aspects of these rules is the provision for commuted leave. This blog post will discuss the eligibility and conditions for availing commuted leaves for railway employees.

What is Commuted Leave?

Commuted Leave is a special type of leave available to Railway servants, allowing them to use their Leave on Half Average Pay (LHAP) at twice the amount of the leave taken, under specific conditions. This type of leave is granted primarily on medical grounds and is designed to provide flexibility in managing leave entitlements.

Conditions for Granting Commuted Leave

1. Reasonable Prospect of Return:

  • Requirement: The authority competent to grant leave must be satisfied that there is a reasonable prospect of the railway servant returning to duty upon expiry of the commuted leave.

2. Debiting Against LHAP:

  • Double Debiting: When commuted leave is granted, twice the amount of such leave is debited against the LHAP account. For example, if 10 days of commuted leave are granted, 20 days will be debited from the LHAP balance.

3. No Limit on Number of Days:

  • Unlimited Entitlement: There is no upper limit on the total number of commuted leave days that can be availed of during the entire service of a Railway servant.

4. Commuted Leave for Approved Courses of Study:

  • Maximum Allowance: LHAP up to a maximum of 180 days can be commuted during service if the leave is utilized for an “Approved Course of Study” that is certified to be in the public interest by the leave sanctioning authority.

5. Treatment on Resignation or Voluntary Retirement:

  • Adjustment on Resignation/Retirement:
    • If a railway servant who has been granted commuted leave resigns or retires voluntarily without returning to duty, the commuted leave is treated as LHAP.
    • The difference between the leave salary for commuted leave and LHAP will be recovered from the employee, unless the retirement is due to compulsory reasons such as ill health or death, in which case no recovery is made.

6. Commuted Leave vs. LAP:

  • Availability with LAP: Commuted leave can be granted even when Leave on Average Pay (LAP) is due to the employee.

Medical Certification Requirements

1. Issuance of Medical Certificate:

  • Railway Doctor’s Certification:
    • As per Para 551 of the Medical Manual [IRMM], a Railway Doctor may issue a certificate covering sickness from an earlier period only if requested by the administration and if the medical authority is satisfied about the genuineness of the case based on available medical evidence.
  • Compassionate Review:
    • The contents of Para 551 of the IRMM should be reviewed with reasonable compassion by all cadre controlling and leave sanctioning authorities for employees across different groups.

1. Compassionate Review:

  • Board’s Directive: The Railway Board has emphasized the importance of compassionate review for requests related to medical certification and leave, ensuring fair treatment of all employees.

2. Notification and Guidelines:

  • Regulatory Compliance: All cadre controlling and leave sanctioning authorities should be aware of and adhere to the guidelines set forth by the Railway Board, ensuring proper handling of commuted leave requests.
